About Mexico RFC Tax Number
Upload of RFC by Mercado Libre Sellers
The Mexican Tax Administration (SAT) recently announced new measures to strengthen the fight against smuggling, tax evasion, and tax avoidance, making compliance with the RFC (Federal Taxpayer Registry) a key concern for sellers. To comply with Mexican tax regulations, Mercado Libre has now notified sellers operating at official overseas warehouse sites in Mexico to provide a valid RFC tax number. Sellers who ship directly or use U.S. forwarding warehouses are not affected by this regulation. This initiative aims to ensure platform compliance and transparency while assisting the Mexican government in regulating tax payments.
What is the RFC Tax Number in Mexico?
RFC (Registro Federal de Contribuyentes) is a unique tax number assigned by the Mexican Tax Administration (SAT) to identify the tax status of individuals and businesses. For sellers operating in Mexico, having an RFC is essential for legal operations, tax declaration, and payment of business income tax.
Main Uses of RFC:
-
Identify taxpayers within Mexico.
-
Facilitate tax declaration and payments for businesses and individuals.
-
Ensure e-commerce sellers comply with Mexican tax regulations, especially in cross-border e-commerce.
Consequences of Not Registering for RFC:
Sellers who do not register and upload their RFC may face the following consequences:
-
Account Functionality Limitations:
-
Mercado Libre may impose restrictions on the accounts of sellers who have not uploaded their RFC, potentially suspending their selling privileges, which affects normal store operations.
-
-
Payment Withholding:
-
Sellers without an RFC may face higher payment withholding rates, directly impacting their earnings.
-
-
Tax Penalties:
-
Operating without an RFC in Mexico may lead to fines and other tax penalties, as well as potential legal disputes.
-
-
Reduced Buyer Trust:
-
Adhering to tax regulations helps build customer trust. Non-compliant sellers may be viewed as unreliable by buyers, affecting their willingness to purchase.
-
How to Register for RFC in Mexico:
-
Application Submission by the Corporate Legal Representative.
-
Where to Submit the Application:
-
Submit a pre-registration (Preinscripción) on the Mexican Tax Service website (SAT), then visit the tax office in person to submit the registration.
-
Schedule an appointment (Cita previa) on the SAT website and present the appointment along with the pre-registration at the tax office.
-
-
Documents Issued After Registration:
-
Application form for RFC registration.
-
Unique proof of RFC registration (Acuse único), which includes the tax identification card (Cédula de identificación fiscal) and a QR code (Código de barras bidimensional).
-
-
Material Requirements for Registration Application:
-
If pre-registration was submitted online, the following documents are required at the tax office:
-
RFC pre-registration proof.
-
Certified copy of the company's incorporation documents.
-
Original proof of the business address.
-
Certified copy of the notarized authorization letter for the legal representative.
-
Original identification document of the legal representative.
-
Every partner, shareholder, or joint partner mentioned in the company's bylaws must have a valid RFC.
-
-
Note: The RFC tax number is also known as the Registro Federal de Contribuyentes, composed of 13 alphanumeric characters, similar to an identification number. The first two characters correspond to the father's surname, the third character is the first letter of the mother's surname, the fourth corresponds to the surname, followed by the birthdate, and the last three are a unique code assigned by the SAT.
-
If the registered entity or joint venture in Mexico has foreign partners, shareholders, or joint partners, they are not required to register their RFC; they use the following universal RFC:
-
Individuals (Personas físicas): EXTF900101NI1
-
Companies (Personas morales): EXT990101NI1
-
If there are special circumstances, additional materials requested by the tax authorities must be submitted.
